MILFORD BOROUGH COMMON COUNCIL REGULAR MEETING DATE: January 3, 2017 CALL TO ORDER The Regular Meeting of the Milford Borough Common Council was held in the Milford Fire Company Building on January 3, 2017. The meeting was called to order by Mayor Ronald A. Rehl at 7:00PM. PLEDGE OF ALLEGIANCE was led by Mayor Ronald Rehl. SUNSHINE PROCLAMATION was read by Mayor Ronald Rehl. As required by the Open Public Meetings Act of 1975, adequate notice of this meeting was provided on December 15, 2016 in the Hunterdon County Democrat and Express Times newspapers. Notices were also posted on the bulletin boards both inside and outside the Municipal Building and at the Milford Public Library. ROLL CALL Present: Ronald R. Rehl, Mayor Carole Heller, Noralie LaFevre, Henry Schepens, George Sniffin, Robert White, Elisa Yager The record reflects the presence of: Todd Bolig, Attorney. NEW BUSINESS Replace Water Line for Customer in Holland Township Mayor Rehl stated Rick Aller, Water Superintendent and Todd Bolig, Borough Attorney have been working on a complaint from a water customer in Holland Township regarding lack of water volume. Rick Aller stated over time zinc in the galvanized steel piping erodes and can lead to an accumulation of corrosion on the inside walls of the pipes. Rick Aller informed Council there is need to inspect/replace the steel water service line at 428 Milford-Mt. Pleasant Road. The Borough Water Department will have to excavate the water service line that connects the properties of 428 and 430 Milford-Mt. Pleasant Road and inspect the service line and replace the line from the existing curb stop to the street if necessary. If the water line needs replacing from the existing stop into the home it will be the homeowner’s responsibility. LEGAL AFFAIRS REPORT – TODD BOLIG Attorney Bolig informed Council that the bankruptcy proceedings for the A&L Oil property are moving forward. SAFETY/ADMINISTRATION – MAYOR REHL Mayor Rehl stated he met with Chuck Urban regarding his plans for the Grist Mill on Railroad Avenue.

ZONING – COUNCILMAN HENRY SCHEPENS Councilman Schepens stated the Zoning Officer did not receive any zoning applications in November. BUILDING & GROUNDS – COUNCILWOMAN LAFEVRE

RE2017-023 WHEREAS, the (3rd) third tax payment of the 2016/2017 school year is due and payable to the Board of Education of Milford Public School on or before January 3, 2017; and WHEREAS, the total of the (3rd) third tax payment is $463,947.00. RESOLUTION NO. 2017-026 TAX CERTIFICATE REDEMPTION OUTSIDE LIENHOLDER WHEREAS, the Tax Collector of the Borough of Milford has been paid by the mortgage holder, Wells Fargo Bank, the necessary amount of $31,520.42 to redeem Tax Sale Certificate #2015-006 on Block 22 Lot 3 on the Borough of Milford Tax List for taxes and subsequent liens supported by filed affidavits: NOW, THEREFORE, BE IT RESOLVED, on the 3rd day of January 2017 by the Common Council of the Borough of Milford, County of Hunterdon, that the Borough Tax Collector upon receipt of the respective above mentioned tax sale certificate, endorsed for cancellation and a true copy of this resolution, be authorized to Cancel the above mentioned liens on Block 22 Lot 3 from the record. RE2017-027 R ESOLUTION OF THE B OROUGH OF M ILFORD , C OUNTY OF H UNTERDON , S TATE OF N EW J ERSEY , A UTHORIZING THE R EPAIR AND / OR R EPLACEMENT OF G ALVANIZED S TEEL W ATER S ERVICE L INES , AND THE P REPARATION OF A PPROPRIATE M AINTENANCE E ASEMENTS TO E FFECTUATE SUCH R EPAIR OR R EPLACEMENT W ITHOUT R EQUIRING F URTHER S PECIFIC A UTHORIZATION BY THE B OROUGH ’ S C OMMON C OUNCIL TO A CCOMPLISH S AME . WHEREAS , for many years, the Borough’s water department utilized galvanized steel piping for its water service lines for connections from the Borough’s water mains to the Borough’s water customers; and WHEREAS , over the years, zinc in the galvanized steel piping erodes and leads to an accumulation of corrosion on the inside walls of the pipes which occasionally results in either reduced water pressure or water volume for the Borough’s customers; and WHEREAS , the Borough, in many cases, does not have an easement which identifies the exact location of the water or sewer lines or which specifically authorizes the Borough to replace and / or maintain those lines; and WHEREAS , the Borough’s Water Department superintendent has indicated that there will be both an immediate and prospective need to replace various existing galvanized service lines, and that there is no way to determine at what point in time specific service lines will need to be replaced; and WHEREAS , the Borough’s Water Department’s superintendent has requested of the Common Council the ability to establish a process by which the Water Department Superintendent may maintain and / or replace those affected lines, and to have either a temporary or permanent maintenance easement drafted to effectuate any such repair and or replacement without requiring further action of the Common Council; and WHEREAS , upon the replacement of any such water service line and its connection to the Borough’s water system, the responsibility for the maintenance and repair, and the replacement, if needed, of the water service line shall be the sole responsibility of the owner(s) of the property served by the water service line. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Milford that: 1. All aforementioned recitals are incorporated herein as though fully set forth at length; and 2. The Borough’s then-serving Water Commissioner in conjunction with the Borough’s Water Superintendent shall have the authority, without further Council approval, to decide which galvanized steel water service lines require repair and / or replacement, and that such decision to replace same shall be made on a case-by-case basis as may be needed; and 3. The Borough’s engineer shall be authorized, on a case-by-case basis, to prepare a legal description (metes and bounds) of the area containing the Borough’s water service line(s), as may be required for a temporary maintenance easement to permit any such water service line replacement; and 4. The Borough shall record any such easement with the Hunterdon County Clerk at the Borough’s sole cost; and

5. Upon the replacement of the water service line, the owner(s) of the property served by the water service line shall bear all responsibility for any costs associated with the replacement, repair and / or maintenance of the water service line, subsequent to the Borough’s installation of same; and 6. This Resolution shall become part of the Borough’s Water Department’s operations manuals. This being submitted at the Council meeting held on Tuesday, January 3, 2017. LEGAL AFFAIRS REPORT – TODD BOLIG Attorney Bolig stated he prepared the lease agreement between the Borough and the Milford Board of Education regarding the Borough garage located at Block 7, Lot 37. Attorney Bolig informed Council that he sent letters to the three residents on Milford-Mt. Pleasant Road regarding their water service line. The letter informed the residents that the Milford Water Department would need to excavate the water service line that connects their property and inspect the service line and possibly replace the line from their existing curb stop to the street if the water service line is determined to be the cause of the problem. Attorney had a brief discussion with members of Council regarding the use of in-house employees removing the A&L Oil building. Attorney Bolig spoke with Stephen Kehays, JM Sorge, Inc. and he stated a contracted company should remove the building. COMMUNITY AFFAIRS – COUNCILMAN ROBERT WHITE • Councilman White stated the Borough could use Office 365 program (cloud based) through Microsoft for the Borough’s email. Councilman White reviewed the program and costs with Council. • Councilman White attended the Planning Board Reorganization meeting and Carol Bernotas was sworn in as Board President. The next Planning Board

meeting is scheduled for January 22, 2017. • Councilman White attended the bid opening for solid waste, recycling and annual clean up on January 10, 2017 and Republic Services was the lowest bidder. • Councilman White reviewed the 2016 Recycling Awards Program sponsored by the NJDEP Bureau of Energy and Sustainability. PUBLIC WORKS – COUNCILMAN GEORGE SNIFFIN Streets and Roads • Councilman Sniffin attended meetings on January 6 th and January 9 th to review the 2017 public works projects • Councilman Sniffin stated the Borough will be applying for two DOT grants for road improvements on Railroad Avenue. • Councilman Sniffin also informed Council that the Road Department will resurface the rest of Hillcrest Drive and grade driveways where required. The Road Department will resurface Orchard and Walnut Streets this year. Sewer Department • The Sewer Department completed the sewer connections for the new property on Fawnwood Drive. • The Sewer Department had an unannounced inspection from the NJ Bureau of Release Prevention to check the chemical stocks and view how the chemicals were stored. The State said everything looked good. Water Department • The Water Department received a service call to 522/524 Frenchtown Road to shut off the water. The Water Department was unable to locate a curb stop for that property. After further inspection on the property it appears a curb stop was never installed. Rick Aller, Water Superintendent informed the property owners that the Water Department would have to cut in a stop if the plumber could not use the basement shut off. Rick Aller has not heard anything from the owners. • The Water Department repaired a 6” water main break on Phyllis Lane. LIAISON – COUNCILWOMAN ELISA YAGER • Councilwoman Yager spoke to the Shoprite Pharmacy representative regarding the cost of Hepatitis B vaccinations for the Milford Fire Department. The Shoprite Pharmacy is willing to provide the vaccinations at the Milford Firehouse for $97.00/shot which is substantially less than Delaware Valley Health Center. The Firehouse Department will need to work with Shoprite on the number of firemen needing the shots. • Councilwoman Yager had a brief discussion with Council members regarding the Milford School sharing the cost of the Milford Public Library. The Mayor and Council Commissioners shall be paid quarterly: in the months of March, June, September and December. 2. The duties and terms of employment of the Borough’s officers and employees, except as otherwise provided by Statute, shall be as set forth in an Ordinance of the Governing Body. The hours of employment and other pertinent information pertaining to the offices and positions shall be set forth in a Resolution of the Governing Body. 5. Those employees who are employed on a full-time basis, as defined by N.J.S.A. 52:14-17.26 , shall also be eligible for the New Jersey State Health Benefits Program, and the Borough of Milford, pursuant to Milford Borough Resolution RE2011-108 has established that employees are deemed to be employed on a full-time basis if said employee works a minimum of twenty-five (25) hours per week. 6. The Treasurer shall present monthly to the Governing Body for approval, warrants drawn to the order of the Borough of Milford Payroll Account as follows: a. In advance for all employees whose salaries are on an annual or weekly basis when such salaries are due and payable prior to the next Regular Meeting of the Governing Body. b. At the first meeting of the Governing Body in January each year there shall be approved an account to be designated “The Borough of Milford Payroll Account” and from time to time the Treasurer, upon receipt of a warrant for the amount due to such payroll account, shall deposit the same to the credit of the Payroll Account, charging the appropriate budgetary accounts therewith. c. The Treasurer shall thereafter draw checks on said payroll account to the employees entitled to payment therefrom. d. At each regular meeting of the Governing Body, the Treasurer shall submit

for the approval or ratification as the case may be, the necessary payrolls for the amount due the officers and employees for compensation. The payroll shall be considered by the Governing Body in due course and approved if found to be correct. e. In case of error adjustment in the payroll, the Treasurer shall, and it shall be his/her duty to see that such error adjustment is properly corrected and an appropriate record made thereof. f. Such officers as may be designated by the Governing Body are hereby authorized to sign warrants drawn in favor of the payroll upon due notice that the appropriate payrolls have been approved by the proper committee and by the proper certifying authorities, which certifying authorities and committee shall be those designated in the Resolution mentioned in Section 5 thereof. 7. MILFORD BOROUGH COMMON COUNCIL REGULAR MEETING DATE: February 6, 2017 CALL TO ORDER The Regular Meeting of the Milford Borough Common Council was held in the Milford Fire Company Building on February 6, 2017. The meeting was called to order by Mayor Ronald A. Rehl at 7:00PM. PLEDGE OF ALLEGIANCE was led by Mayor Ronald Rehl. SUNSHINE PROCLAMATION was read by Mayor Ronald Rehl. As required by the Open Public Meetings Act of 1975, adequate notice of this meeting was provided on December 15, 2016 in the Hunterdon County Democrat and Express Times newspapers. Notices were also posted on the bulletin boards both inside and outside the Municipal Building and at the Milford Public Library. ROLL CALL Present: Ronald R. NEW BUSINESS Milford Fire Company – Cap Water and Sewer for Property located at 27 Water Street John Phillips, Milford Fire Company representative stated the Fire Company purchased 27 Water Street property and the Fire Company would like to have the water and sewer disconnected to the property. The house on the property will probably be demolished in the Spring and used as a parking lot. After a brief discussion Council authorized the water and sewer fees to be waived. Letter from Milford Merchant Association – 2017 Events Noralie LaFevre made a motion to accept the letter presented from the Milford Merchant Association for 2017 events. Seconded by Elisa Yager. UNFINISHED BUSINESS A&L Oil – Follow up discussion regarding application for HDSRF Grant with Steve Keyhays • Attorney Bolig informed Council that the foreclosure process should be completed within the next two weeks. Steve Keyhays, JM Sorge, Inc. stated the proposal from Willever Excavating includes demolition of the entire building

including contents and removal. The disposition of material will be sent to a licensed disposal facility. The Borough will need to get two more quotes on demolition and disposal. Per Steve Kehays stated there is no need for further testing of the building materials unless asbestos is discovered. • Also, the Hazardous Discharge Site Remediation Fund Municipal Grant package will need a signed contract with JM Sorge, Inc. and a contract with the demolition contractor and resolutions for both. • The Borough will be proceeding with the grant in two phases: (1) preliminary assessment and (2) remedial investigation. Please see resolution number RE2017-037 authorizing the Mayor to execute grant documents as an authorized representative for the Borough. Verizon Wireless Request for Consent from Milford Borough – possible Joint Meeting with Planning Board Attorney Bolig informed Council that the wireless providers are allowed to work in a public right-a-way. The Borough will have to give consent but the Borough could also set standards. After a brief discussion on the matter, Council decided to hold a joint meeting with the Planning Board to review the matter. The Borough Clerk will work with the Planning Board Secretary to schedule a joint meeting on February 21, 2017. Request from Planning Board to approve Planner’s quote regarding Master Plan Re- examination and Water Street Study RESOLUTION NO. RE2017-038 BE IT HEREBY RESOLVED by the MILFORD BOROUGH COMMON COUNCIL that Mary Moody, Planner is hereby authorized to prepare the Borough of Milford’s Master Plan Re-examination in conjunction with the Water Street Study. The total cost of the Water Street Study and Master Plan Re-examination will be $8,060.00. This being submitted at the Council meeting held on February 7, 2017. SAFETY/ADMINISTRATION – MAYOR REHL Mayor Rehl had several meetings regarding the railroad and funding on restoring the railroad. Mayor Rehl stated Hunterdon County would like to start a fund raising effort on repairing the railroad. ZONING – COUNCILMAN HENRY SCHEPENS Councilman Schepens stated on Sunday he saw a crew working on the railroad ties. Councilman Schepens also stated the County is very interested in the train tracks. BUILDING & GROUNDS – COUNCILWOMAN LAFEVRE Building & Grounds Councilwoman LaFevre stated the cistern on the waterworks field has been filled. Local Business Councilwoman LaFevre stated the Milford Merchant Association held their first meeting for 2017. The Merchant Association discussed the following: Christmas in Milford, a merchant networking night, Chocolate in the Oven is holding a baking class. The Presbyterian Church also presented there calendar of events for 2017, Judit Hendricks, Weichert Realty will be holding a seminar “Find Out What’s Going on in your Community”. ORDINANCE – FIRST READING ORDINANCE NO. 868-2017 CALENDAR YEAR 2017 ORDINANCE TO EXCEED THE MUNICIPAL BUDGET APPROPRIATION LIMITS AND TO ESTABLISH A CAP BANK (N.J.S.A. 40A: 4-45.14) WHEREAS , the Local Government Cap Law, N.J.S.A. 40A: 4-45.1 et seq., provides that in the preparation of its annual budget, a municipality shall limit any increase in said budget to 2.5% unless authorized by ordinance to increase it to 3.5% over the previous year’s final appropriations, subject to certain exceptions; and, WHEREAS, N.J.S.A. 40A: 4-45.15a provides that a municipality may, when authorized by ordinance, appropriate the difference between the amount of its actual final appropriation and the 3.5% percentage rate as an exception to its final appropriations in either of the next two succeeding years; and, WHEREAS , the Common Council of the Borough of Milford in the County of Hunterdon finds it advisable and necessary to increase its CY 2017 budget by up to 3.5% over the previous year’s final appropriations, in the interest of promoting the health, safety and welfare of the citizens; and, WHEREAS , the Common Council of the Borough of Milford hereby determines that a 3.5 % increase in the budget for said year, amounting to $ 36,157.14 in excess of the increase in final appropriations otherwise permitted by the Local Government Cap Law, is advisable and necessary; and,

WHEREAS, the Common Council of the Borough of Milford hereby determines that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years. NOW THEREFORE BE IT ORDAINED , by the Common Council of the Milford, in the County of Hunterdon, a majority of the full authorized membership of this governing body affirmatively concurring, that, in the CY 2017 budget year, the final appropriations of the Borough of Milford shall, in accordance with this ordinance and N.J.S.A. 40A: 4- 45.14, be increased by 3.5 %, amounting to $36,157.14, and that the CY 2017 municipal budget for the Borough of Milford be approved and adopted in accordance with this ordinance; and, BE IT FURTHER ORDAINED, that any amount authorized hereinabove that is not appropriated as part of the final budget shall be retained as an exception to final appropriation in either of the next two succeeding years; and, BE IT FURTHER ORDAINED , that a certified copy of this ordinance as introduced be filed with the Director of the Division of Local Government Services within 5 days of introduction; and, BE IT FURTHER ORDAINED , that a certified copy of this ordinance upon adoption, with the recorded vote included thereon, be filed with said Director within 5 days after such adoption.
