MILFORD BOROUGH COMMON COUNCIL REGULAR MEETING DATE: January 3, 2011 CALL TO ORDER The Regular Meeting of the Milford Borough Common Council was held in the Milford Fire Company Building on January 3, 2011. The meeting was called to order by Mayor James Gallos at 7:00PM. PLEDGE OFALLEGIANCE was led by Mayor Gallos. SUNSHINE PROCLAMATION was read by Mayor James Gallos. As required by the Open Public Meetings Act of 1975, adequate notice of this meeting was provided on December 23, 2010 in the Hunterdon County Democrat and Express Times newspapers. Notices were also posted on the bulletin boards both inside and outside the Municipal Building and at the Milford Public Library. ROLL CALL Present: James A. Gallos, Mayor Barbara Corrigan, Carole Heller, Noralie LaFevre, John Phillips, Donald Pursell, George Sniffin The record reflects the absence of: Todd Bolig, Attorney. UNFINISHED BUSINESS Mayor Gallos stated there is a need to form a sub-committee to work on the renewal of the Service Electric Cable TV contract. Mayor Gallos will look for volunteers at the next meeting. PUBLIC COMMENT John Phillips made a motion to open the meeting to public comments. Seconded by Donald Pursell. ROLL CALL VOTE: AYES: B. Honeysuckle Lane Road Improvement Bid Attorney Bolig stated he reviewed the bids on the road improvement project and originally thought Top Line Construction was on the debarred contractors list, but after further review it was Top Line Contractors who were on the debarred list. Top Line Construction provided the Borough with a notarized letter stating Top Line Construction Corp. is an unrelated and unaffiliated entity from Top Line Contractors Corp. Sludge Bid Results Attorney Bolig reviewed the two bids from Russell Reid and Spectraserv. The bid from Russell Reid, which was the lowest bid had conditions on the bid, which made the bid a non-conforming bid. Therefore, the bid received from Spectraserv was a fully conforming bid and a resolution will be presented tonight to award the sludge bid to Spectraserv. SAFETY/ADMINISTRATION – JAMES GALLOS Mayor Gallos will be attending the 19 th Mayor Legislative Day on February 16, 2011. Mayor Gallos and Councilman Sniffin had a brief discussion regarding forming a solar energy sub- committee which included Borough residents. After the discussion it was decided to keep the current sub-committee members of George Sniffin, John Phillips and Donald Pursell. BOROUGH MAINTENANCE – COUNCILMAN PHILLIPS  The Road Department prepared the spreaders for the winter season.  The Road Department cut up a hemlock tree on the York Street Well property.  The Road Department plowed and salted on December 26 and December 27. FINANCE – COUNCILWOMAN HELLER Councilwoman Heller stated the tax sale was held on December 30, 2010. RESOLUTIONS RESOLUTION NO. RE2011-022 WHEREAS, the (3rd) third tax payment of the 2010/2011 school year is due and payable to the Board of Education of Milford Public School on or before January 1, 2011; and WHEREAS, the total of the (3rd) third tax payment is $423,471.25. THEREFORE IT IS HEREBY RESOLVED by the MILFORD BOROUGH

COMMON COUNCIL that the (1st) first tax payment to the Local School in the amount of $423,471.25 be and is ordered paid to the Milford Public School Board of Education on or before January 1, 2011. Clerico, Borough Engineer, has reviewed the submitted bids and determined that Top Line Construction, 22 Fifth Street, Somerville, New Jersey submitted the lowest responsive bid in the amount of $170,672.77; WHEREAS , the Borough of Milford has sufficient funds to cover this Contract. RE2011-026 WHEREAS, in 2010, the Borough of Milford’s Common Council, pursuant to the Public Contracts Law, N.J.S.A . 40A:11-1, et seq ., advertised for bids for the collection and disposal of the sewage sludge cake generated by the Borough’s Wastewater Treatment Plant; and WHEREAS, the Borough solicited bids seeking the collection and disposal of aforesaid sewage sludge cake under three alternatives, to wit: Collection for one year (2011); collection for two years (2011 and 2012); and collection for three years (2011, 2012 and 2013) to be determined in the Borough’s sole discretion as to which of the three alternatives shall be implemented: and WHEREAS, the Borough timely received bids from two vendors, to wit: Russell Reid Waste Hauling & Disposal Service, Inc., 200 Smith Street, Keasbey, New Jersey 08832 (“Reid”), and Spectraserv Inc., 75 Jacobus Avenue, South Kearny, New Jersey 07032 (“Spectraserv”); and WHEREAS, the Bids were opened on December 28, 2010 by the Borough with Reid and Spectraserv each submitting timely bids in accordance with the Borough’s bid specifications and applicable law; and WHEREAS, the bids received were as follows: Contractor Alternatives Unit Price Total Spectraserv One Year (Alternate A) $135.00 $59,400.00 Two Years (Alternate B) $135.00 $118,800.00 Three Years (Alternate C) $135.00 $178,200.00

Pennsauken , 196 N.J.Super. , 241, 482 A.2d 184 (App.Div. 1983), denies the Borough of the assurance that the contract will be entered into, performed and guaranteed according to the bid specifications and requirements; and WHEREAS , the Borough Attorney, in conjunction with the Borough’s Engineer, Robert Clerico, PE, of Van Cleef Engineering Associates, has reviewed the submitted bids and determined that Spectraserv has submitted the lowest compliant Bid; and WHEREAS , the Borough has opted to exercise Alternate A; and WHEREAS , the Borough has appropriated sufficient funds to award the Bid, under Alternate A, to Spectraserv, Inc., in the amount of $59,400.00. NOW THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Milford that: 1. The Contract for the Collection and Disposal of the Borough’s Sewage Sludge Cake be and is hereby awarded to Spectraserv Inc., 75 Jacobus Avenue, South Kearny, New Jersey 07032, under Alternate A for their Bid of $59,400.00; and 2. The Contract is awarded as a unit price bid Contract and final payment will be based upon the actual quantity of sewage sludge cake collected and disposed of by Spectraserv at the $135.00 unit price bid per ton, as set forth in the Borough’s Plans and Specifications. RE2011-001 BE IT HEREBY RESOLVED by the MILFORD BOROUGH COMMON COUNCIL that the Official Time and Place for the Borough Council Regular Monthly Meetings shall be set for the First Monday of each month and the Third Monday of each month, unless otherwise specified, in which case the date shall be set at the discretion of the Council. RE2011-003 RESOLUTION OF THE BOROUGH OF MILFORD, COUNTY OF HUNTERDON, STATE OF NEW JERSEY FIXING THE RATE OF INTEREST TO BE CHARGED ON DELINQUENT TAXES OR ASSESSMENTS. WHEREAS , N.J.S.A. 54:4-67 permits the governing body of each municipality to fix the rate of interest to be charged for non-payment of taxes or assessment subject to any abatement or discount for the late payment of taxes as proved by law; and WHEREAS , N.J.S.A. 54:4-67 has been amended to permit the fixing of said rate of 8% per annum on the first $1,500.00 of the delinquency and 18% per annum on any amount in excess of $1,500.00 and allows an additional penalty of 6% be collected against a delinquency in excess of nofficial Document

$10,000.00 on properties that fail to pay the delinquency prior to the end of the calendar year; NOW, THEREFORE, BE IT RESOLVED , by the Common Council of the Borough of Milford, County of Hunterdon, State of New Jersey, as follows: 1. The Tax Collector is hereby authorized and directed to charge 8% per annum on the first $1,500.00 of taxes becoming delinquent after the due date and 18% per annum on any amount of taxes in excess of $1,500.00 becoming delinquent after the due date and if a delinquency is in excess of $10,000.00 and remains in arrears beyond December 31 st , an additional penalty of 6% shall be charged against the delinquency. Effective January 1, 2011 there will be a ten (10) day grace period of quarterly tax payments made by cash, check or money order. 2. Any payments not made in accordance with paragraph two of this resolution shall be charged interest from the due date as set forth in paragraph one of this resolution. 3. A Certified copy of this resolution shall be provided by the Borough Clerk to the Tax Collector, the Borough Attorney and Borough Auditor for the Borough of Milford. RESOLUTION NO. RE2011-004 BE IT HEREBY RESOLVED by the MILFORD BOROUGH COMMON COUNCIL that the TEMPORARY BUDGETS FOR 2011, with the following appropriations, be and is hereby adopted: General Operations (Municipal) $278,981.00 Water Department $ 47,993.00 Sewer Utility $ 94,789.00 RESOLUTION NO. RE2011-005 WHEREAS, the Common Council has been informed by the Tax Assessor of the Borough of Milford, that from time to time, the Assessor may be required to execute stipulations relative to assessment appeals, to make corrections in assessments on properties located in the Borough of Milford, and to file omitted assessments and roll back tax complaints and appeals, all in the name of the Borough of Milford; and WHEREAS, the Hunterdon County Board of Taxation requires a resolution of the Common Council to authorize actions by the Assessor; and WHEREAS, the Common Council desires to grant such authority to the Assessor, subject to the conditions set herein. RE2011-009 ESTABLISHINGA PETTY CASH FUND WHEREAS , N.J.S.A. 40A:5-21 authorizes the establishment of a Petty Cash Fund in any county or municipality by application and resolution; and WHEREAS , it is the desire of the Common Council of the Borough of Milford, County of Hunterdon to establish such a fund for the Borough Clerk’s Office in the amount of $50.00; and WHEREAS , the custodian for this fund is Karen Dysart, Municipal Clerk, who is bonded for the amount of $2,000.00; such custodian shall maintain records for this fund in a manner conducive to proper accounting and auditing procedures; and NOW, THEREFORE BE IT RESOLVED that the Milford Borough Common Council hereby authorizes such action and that two copies of this resolution be filed with the Division of Local Government Services, New Jersey Department of Community Affairs for approval. nofficial Document

2010 RECYCLING TONNAGE GRANT RESOLUTION NO. RE2011-010

WHEREAS , the Mandatory Source Separation and Recycling Act, P.L. 1987, c.102, has established a recycling fund from which tonnage grants may be made to municipalities in order to encourage local separation and recycling programs; and WHEREAS , it is the intent and spirit of the Mandatory Source Separation and Recycling Act to use the tonnage grants to develop new municipal recycling programs and to continue and expand existing programs; and WHEREAS , the New Jersey Department of Environmental Protection is promulgating recycling regulations to implement the Mandatory Source Separation and Recycling Act; and WHEREAS , the recycling regulations impose on municipalities certain requirements as a condition for applying for tonnage grants including, but not limited to, making and keeping accurate, verifiable records of materials collected and claimed by the municipality; and WHEREAS , a resolution authorizing this municipality to apply for such tonnage grants will memorialize the commitment of this municipality to recycling and indicate the assent of the Common Council to the efforts undertaken by the municipality and the requirements contained in the Recycling Act and recycling regulations; and WHEREAS , such resolution should designate the individual authorized to ensure that the application is properly completed and timely filed. WHEREAS , Karen Dysart, Municipal Clerk, is hereby designated to prepare the 2010 Recycling Tonnage report. NOW THEREFORE, BE IT RESOLVED , by the COMMON COUNCIL OF THE BOROUGH OF MILFORD, in the County of Hunterdon, State of New Jersey, that the Borough of Milford hereby endorses the submission of a Municipal Recycling Tonnage Grant Application to the New Jersey Department of Environmental Protection, and Karen Dysart, RMC, is the person authorized to prepare such application and ensure that the same is properly filed. RESOLUTION NO. RE2011-011 WHEREAS, the County of Hunterdon granted approval upon the traffic signal installation contingent on it being operated and continuously maintained in accordance with Plan LTS-3572 dated June 25, 1993 and Signal Timing Schedule dated June 26, 1993; and WHEREAS, The Borough of Milford is in need of professional advice for Electrical Services for the purpose of instituting maintenance program for the Traffic Signal; WHEREAS, sufficient funds are available to pay the costs of these purposes; and WHEREAS , the Local Public Contracts Law (NJSA 40A:11-5 et seq) requires a resolution authorizing the award of contracts for Professional Services without competitive bidding must be advertised. Borough Clerk will contact Dawn Merante and check what date would work for her. Letter from Kocsis Farm LLC regarding Use of the Borough Farm Borough Council received a letter from Kocsis Farm with a proposal to use the property to grow corn. Kocsis Farm would agree to leave a 15 foot mowed path around all fields for use by the public and will leave an access path and open space around each test well if necessary. After a brief Council discussion it was decided the farm should be left vacant. Noralie LaFevre made a motion to authorize the Borough Attorney to send a letter to Kocsis Farm LLC stating the Borough is not interested in farming at the present time. Review Draft Solar Ordinance The Borough Council reviewed the draft ordinance amending the Land Use regulations of the Borough specifically Chapter 190: Zoning: Renewable Energy Facilities. Borough Council members reviewed the ordinance in its entirety and made changes throughout the ordinance. Attorney Bolig will make the changes to the draft ordinance and forward to the Planning Board for their review. PUBLIC COMMENT John Phillips made a motion to open the meeting to public comments. Ms. Hunt had many questions regarding the location, environmental impact study, and concerns with endangered animals on the Borough Farm. PUBLIC WORKS – Councilman Sniffin Councilman Sniffin and Councilman Phillips met with representatives regarding solar energy panels at the Borough Farm.

Water Department  Councilman Sniffin stated there is a need for an ordinance to provide water customers a allowable amount of time to repair a water leak. Attorney Bolig will prepare an ordinance for Council's review.  Milford Market called Rick Aller stating they hear running water at the store. After further investigation it was determined there was a water leak on the customer side of the valve and it was repaired the following day.  Milford Atlantic/Jim's Auto Body hooked into the Borough's water system. Sewer Department  Councilman Sniffin, Rick Aller, Thomas Ferry Borough Auditor; Dawn Merante, CFO; met with Dan Bush and Tony Roselle, Committee Representatives from Holland Township and Peter Rees, CFO from Holland Township regarding the 2009 Sewer Plant Audit. The Holland Township representatives were also updated on the sewer plant upgrade and had questions on the sewer allocations answered. Rick Aller gave Dan Bush and Tony Roselle a tour of the sewer plant.  The Sewer Department is now using the SOMAT unit to thicken sludge full time. The Sewer Department also finished filling the new digester and completed start-up with the Philly mixer, the new tanks are now in use. Rick is experiencing a severe problem with icing in the tank and he is in the process of building covers for the tanks. SOLID WASTE MANAGEMENT – Councilwoman LaFevre Councilwoman LaFevre reported the Recycling for 2010 was 149.78 tons for a cost of $14,978.00 and garbage was 540.62 tons for a total cost of $40,276.19. COMMUNITY AFFAIRS – Councilman Pursell RESOLUTION NO. RE2011-027 WHEREAS, The Borough of Milford requires Raffles, held in the Borough, to be licensed; and WHEREAS , All copies of the applications have been received, reviewed and found in order; and WHEREAS , All the regulations of the Borough Ordinance have been met. RESOLUTION NO. RE2011-028 REQUESTING THE HUNTERDON COUNTY FREEHOLDERS ENGAGE IN AN ANALYSIS OF MUNICIPAL SERVICES WHEREAS, the cost of operating school districts generally represents the largest component of property owners' overall property tax bills; and WHEREAS, there are twenty-six municipalities in Hunterdon County; and WHEREAS, State policies favor the sharing of services among public entities; and WHEREAS, for the those municipalities that maintain local police departments, the cost of operating local police departments generally represents the largest part of the municipal component of the overall property tax bill. NOW, THEREFORE, BE IT RESOLVED by the Mayor and Council of the Borough of Milford, in the County of Hunterdon, that the Hunterdon County Board of Chosen Freeholders is hereby encouraged to seek grant money from the State of New Jersey to conduct an analysis of all government services including school districts within Hunterdon County to determine whether any significant economies or efficiencies could be gained through the operation of said services by Hunterdon County rather than individual municipalities; and BE IT FURTHER RESOLVED that a true copy of this resolution shall be sent to the Hunterdon County Board of Chosen Freeholders and every municipality located within the County . NEW BUSINESS Garden State Underwater Recovery – 2011 Annual Report Frank Nester, Garden State Underwater Recovery presented to Council their 2011 Annual Report. The Garden State Underwater Recovery Unit is a non-profit volunteer organization of scuba divers, boating safety instructors and boat operators. Each active member of GSURU undergoes a three-year program of training and education in order to participate with the team. GSURU hosts many training programs: NJ Boating Safety Certificate, Open Water Diving, Ice Diving, Rescue Diving, Red Cross CPR and First Aid and many other training programs. During 2010 the GSURU remains debt free and able to fund all operations through income sources without tapping capital improvements or savings funds. The Garden State Underwater Recovery continues to service the community of Milford and Hunterdon County with their unique abilities/increase water safety awareness. Mayor and Council thanked Frank Nester for a very informative presentation. Mayor Gallos stated that the Borough Council will not be discussing the ordinance regarding solar energy tonight. The ordinance was forwarded to the Planning Board for review last month. Unfortunately, the last two Planning Board meetings have been canceled due to inclement weather.
