Minutes – Hardwick Township Zoning Board of Adjustment January 16, 2007

Designation of Meeting Date, Time and Place Ms. Pflugh made the motion to designate the meeting dates as the third Tuesday of the month, convening at 7:30 p.m., at the Hardwick Township Municipal Building, Spring Valley Road, Hardwick, Warren County, New Jersey. Motion seconded by Ms. Dwyer.

In a roll call vote, all were in favor. Designation of Official Newspaper

Ms. Dwyer made the motion to designate the NJ Herald as the Official Newspaper and the NJ Herald and the Express Times as the newspapers designated to receive notices pursuant to the Open Public Meetings Act. Motion seconded by Mr. Hughes. In a voice

The regular meeting minutes of November 21, 2006 were distributed prior to the meeting. Mr. Bennett made the motion to adopt the minutes. Motion seconded by Ms. Pflugh. In a voice vote, all were in favor. Memorializing Resolutions: #06-003 R. P. Machine, LLC, Block 304, Lot 13 Chairman Satta reviewed Attorney Keiling’s request that the adoption of the Resolution be deferred until next month. New Business: #07-002 Kevin & Jessica Gulick, Block 1003, Lot 16.01-Completness The Board Secretary noted that she spoke with the Applicant and they have verbally withdrawn their application. Chairman Satta stated that the Board will deal with this application after determining the completeness for Petrie. #07-001 Richard & Donna Petrie, Block 601, Lot 17.04-Completeness Ms. Pflugh recused herself and sat in the audience. Dominick Santini, Esq. was present on behalf of the Applicant. He stated that his client received a front yard setback variance, in 2005; however, there is not enough room to erect a front porch with steps. He then went on to review Board Engineer Rodman’s completeness report. He stated that the house was staked out; however, it was not constructed in the correct spot. He stated that the house is a log house and they are two week away from a certificate of occupancy. Board Engineer Rodman stated that the footprint of the house is slightly different from the original variance plan. The Board discussed the waiver from the requirement to show the prevailing front and rear yard setbacks for adjoining lots and Attorney Santini stated that the Applicant had provided verbal testimony on this issue at the previous hearing. Mr. Hughes made the motion to grant the waiver for the prevailing front and rear yard setbacks for adjoining lots. Motion seconded by Ms. Dwyer. In a voice vote, all were in favor. Mr. Hughes made the motion to deem the application complete. Motion seconded by Mr. Ebbels. In a voice vote, all were in favor.

Attorney Santini asked if the Board would consider making a recommendation that a TCO be issued, since the home that is presently constructed, without the front porch or step, is not in violation of the variance that was previously granted. nofficial Document
